“If the government wanted to charge Hamdan with aiding and abetting terrorism or some other war crime that was sufficiently rooted in the international law of war at the time of Hamdan’s conduct, it should have done so,” wrote Judge Brett Kavanaugh of the U.S. Circuit Court of Appeals for the District of Columbia. He was joined by two other judges, all appointed by Republican presidents.

The Judges made a correct ruling. Muffin is right, it shows why these cases have should not be in civilian court. Our court system is not an international tribunal. Nor do we want it to be. If he committed a crime here on this land then he should be charged with the laws we have here. If he committed a crime in a different country then he should be tried by those laws. If it is something done during war within the process of that war then it should be a military tribunal. If the crime transcends norms of humanity then it should be an international tribunal.
